Argentina: advances in a specific tariff arrangement for social organizations

The initiative has 29 articles where it establishes differential treatment for this kind of organizations that do not pursue any lucrative activities. The tariffs involved in the arrangement are the ones that these organizations have to allocate to drinkable water, sanitation, electricity, gas and basic telephony.

The Chamber of representatives has approved and sent to the Senate a project submitted by its President, Julián Domínguez, in order to create a new tariff arrangement especific for social organizations.The initiative has 29 articles where it establishes differential treatment for this kind of organizations that do not pursue any lucrative activities. The tariffs involved in the arrangement are the ones that these organizations have to allocate to drinkable water, sanitation, electricity, gas and basic telephony.

According to the substantiation of the project, organizations are now equated to industires or companies, when in reality they do not have the same economic resources: These is the issue that this bill tries to address.

The chamber also approved another arrangement that aims to provide legal and patrimonial protection to the ‘social utility goods’, meaning those that re used by the organizations in order to develop their activities and fulfill its objectives.

The initiative establishes that ‘the social utility good can’t be alienated nor taxed without the approval of a majority of the members of the organization that have voting rights, expressed in the extraordinary assembly convoked to that effect”.

Furthermore, it can’t be “seized nor executed because of debts that are posterior to its registration, nor in any other case, with the exception of the obligations stemming from labour credits, price differentials for the acquisition of a real estate asset, taxes for public services allocated to the asset or credit originated for construction introduced in the asset”.
